Disqualification of 20 AAP MLAs Set Aside - By: Delhi High Court

The Delhi High Courtís verdict setting aside the Election Commissionís order disqualifying 20 Aam Aadmi Party MLAs was a huge victory for the party and a stinging indictment of the EC. The EC was not merely incorrect in its interpretation of the law on office of profit, but had wilfully denied AAP MLAs an opportunity to defend themselves in the case.

In effect, this means that the actions of the EC were patently mala fide. It is a worrying sign for our democracy that the body that is mandated to ensure free and fair elections has been found guilty of denying voters the elected representatives of their choice. This legal victory was followed by several others: Transport Minister Kailash Gahlot, MLAs Manoj Kumar and Naresh Balyan were all acquitted by the courts in some of the politically motivated and false cases registered against them.

Unfortunately, the collective might of the BJP-led Central government has been used to embroil AAP leaders in endless litigation in an effort to drain us of the energy and resources needed to fight the battle against corruption and vested interests.
