Highlights and Sharing Experience as Related:



1. First of all, it cannot said to be or presumed as ‘This was the ‘Surprise Check-Raid’ as appears from the way serving the meal to the Learned Judge etc in new and exceptional utensils with heads properly covered by the serving staff who are always prisoners and never seen serving so.



2. The ‘Surprise Check-Raid’ by ‘Over 20 Judges Sudden Such Conducting Surprise Check-Raid in the History at Central Jail in Ludhiana’ can’t be without the knowledge of District Administration, who is directly and indirectly mingled-speak to people; ‘to circulate among a group of people such as guests at a party’ closely with some politicians, who control Jail staff normally to get them posted of their choice or option from high-ups as it is a matter of common sense and supposed to be in the open knowledge of all, though exceptions can’t to be ruled out forever.



3. Moreover, it is difficult to keep such visits as ‘Surprise Checks-Raids’ due to security reasons of ‘Over 20 Judges’ as reported.



4. As being reported and claimed in ‘Over 20 Learned Judges Sudden Such Conducting Surprise Check-Raid in the History at Central Jail in Ludhiana’ that ‘all the judges interacted with 3,350 inmates and undertrials and took their feedback about their problems’. (It seems not possible within three hours time as reported)



5. Have Central Jail Ludhiana sufficient accommodation and other facilities for 3,350 prisoners and undertrials in the Central Jail Ludhiana?



6. Over 20 Learned Judges must have noticed with a naked eye that 3,350 prisoners and undertrials in the Central Jail Ludhiana have no sufficient accommodation and unprivileged sleep on floors within Varanda Grills in the prisoners locked blocks or prisoners cell.



7. Some influential with their money power do quickly manage known as ‘ KHADDA’ or Bed-Sleeping Couch, But common man even undergoing life prison just get about two feet width space on known as ‘ KHADDA’ along with the most bad smelling blankets and without side support and help of Jail staff, the prisoners and undertrials have no safety and security in Indians Jails as I personally noticed at ‘Central Jail in Ludhiana’ .



8. Over 20 Learned Judges in three hours time must have enquired as to how gangsters, influential having money power and backed by the nexus between the criminal gangs, police, bureaucracy and politicians, as this practice prevailing also can’t be ruled out such practice prevailing all over India, live in like bosses unchecked and whereas the common and unprivileged prisoners are worst than slaves without any safety and security in Jail as noticed.



9. No-doubt, preparation of food includes only Dal and Phulka / Roti | Chapati was satisfactory as then heard from the prisoners and undertrials that then known as Deputy Superintendent Cheema is himself supervising the food after tasting it. But, as noticed, Langar Preparation Room-COOKING ROOM was not so clean and hygienic at ‘Central Jail in Ludhiana’ What to talk of Bath-Rooms and the shortage of water in the context for overcrowded prisoners and undertrials.



10. As from the experience and wrote earlier also, ‘Because the monthly visits of District and Sessions, Judges to their respective District Jails to meet the victims among the convicts and under- trials, do not serve much purpose satisfactorily for number of reasons as the author of this note personally noticed and experienced as it shall not be proper to elaborate now as personally experienced in Jail’.



11. Have the government of India and or the States in India never or ever bothered to get any secret reports about and in the interest of fair play and justice for safeguarding the victims of adverse circumstances and for the reasons their dependents stand settled or suffering and or impelled and compelled to be criminals, druggists in the hands of gangsters supported and backed by the nexus between the criminal gangs, police, bureaucracy and politicians in the present system prevailing in India.





12. I wish to quote here one case of an Ex-Serviceman, who was at Central Jail in Ludhiana:



(i) The victims of adverse circumstances excluding and forgetting my own case story, I wish to quote here one case of an Ex-Serviceman, who was in Jail Ludhiana under sections 107/151 Cr. P. C from which Village Mangli, Ludhiana, exactly can’t say? The Ex-Serviceman approached me in Jail after knowing that I am an advocate and he narrated his entire story since more than 8 (eight) months in Jail, Ludhiana unheard so far,



(ii) He said, “My wife and my father have good relations with each other and they never liked my presence in our home”. As to why so, you must be drinking more and daily in your home. He replied in negative but quickly said sometimes I do drink but never quarreled with them.



(iii) “With the support of local police, they (My wife and my father) involved me falsely and nobody from the village came forward for my bail in this case from the fear of my wife and my father, avoided by saying it is your family matter”. He said.



(iv) Could it be in similar cases, the painful stories of all presently serving soldiers and ex-servicemen in the present system of India?



(v) He further said, “Moreover soldiers are mostly to live in fields and remain cut off from family and society and nobody trust us”. He was not knowing as to whom, he is narrating the entire painful story is also an ex-airman.



(vi) Then, I enquired from him, as to why the courts have not heard you in such a silly and non-criminal case more than 8 (eight) months in Jail, Ludhiana so far?



(vii) His prompt reply was, “I was never taken to court and get next date of hearing through video conferencing without asking me anything and similarly happens with others”.



(viii) I did also notice there during my stay, about 100 to 200 undertrials dealt similarly within a few minutes without any hearing.



(ix) Without checking any his documents relating to his case etc, after hearing the entire painful story of the Ex-Serviceman, I guided him and told him that you with folded hands narrate all this your entire painful story to the ‘Duty Judicial Magistrate’ or the Magistrate or Police Commissioner concerned or whatsoever, you will be definitely freed-acquitted and same thing happened in his case.



13. Now, I personally felt encouraged to know that, ‘The District & Sessions Judge Gurbir Singh said the judges would be preparing a detailed report, which would be discussed in detail later. Action would be taken later regarding any changes to be made with respect to the functioning of the jail’.



14. AN IMPORTANT SUBMISSION MADE EARLIER AS UNDER:

16. Here not means may be for untold and unseen reasons like undue pressure and influence by way of tutoring by the hidden secret agencies in violation of the constitutional principles and also committing delay at Will, motivation, for some motive and for some purpose and incentive-revengefully etc.



17. Because the monthly visits of District and Sessions, Judges to their respective District Jails to meet the victims among the convicts and under- trials, do not serve much purpose satisfactorily for number of reasons as the author of this note personally noticed and experienced as it shall not be proper to elaborate now as personally experienced in Jail.



18. Like, ‘The Truth finding Committee of Victims in Indian Jails’ comprising some upright personalities (not at all related directly or indirectly also with victims concerned) could be set up to ascertain the truth about the mind of victims.

20. Over 20 Judges Sudden Such Conducting Surprise Check-Raid in the History at Central Jail in Ludhiana:



(i) The surprise check was organised under the "Connect to Serve" campaign: The District & Sessions Judge Gurbir Singh along with 20 other judges conducted a surprise check at the Central Jail in Ludhiana today.



(ii) The District & Sessions Judge Gurbir Singh was also accompanied by District Legal Services Authority (DLSA) Secretary c** Chief Judicial Magistrate Dr Gurpreet Kaur, several other judges, Jail Superintendent S S Boparai, besides others.



(iii) It is pertinent to mention that this is for the first time in the state that more than 20 judges have conducted a surprise check in a jail and during today's surprise check, all the judges interacted with 3,350 inmates and undertrials and took their feedback about their problems.



(iv) Different teams were formed and they visited different barracks, he said. Besides, the judges took notice of the basic facilities, kitchen, food, bathroom, jail security and other aspects.



(v) The District & Sessions Judge Gurbir Singh said the judges would be preparing a detailed report, which would be discussed in detail later. Action would be taken later regarding any changes to be made with respect to the functioning of the jail.
